Can NRIs and OCIs Buy Property in India? The Rules, Plainly

Yes — if you hold an Indian passport abroad (NRI) or an OCI card, you can buy residential and commercial property in India, and there is no limit on how many. The rules that trip people up are narrower than the fear around them: what you cannot buy, how the money must move, and the paperwork for buying without being here. This guide covers each, plainly.

Who can buy, and what

Under FEMA's general permission, NRIs and OCI cardholders can freely purchase residential and commercial property in India. No prior approval from the RBI is needed, and there is no ceiling on the number of properties you can hold.

The prohibited list is specific: agricultural land, plantation property and farmhouses cannot be purchased by NRIs or OCIs without specific RBI approval. You can, however, inherit agricultural land, and property received by inheritance or gift is treated under its own rules.

Foreign citizens who are not OCI cardholders and not resident in India generally cannot buy property here, with narrow exceptions (inheritance, or RBI approval). If your spouse or co-buyer is a foreign national without OCI status, structure the ownership before you commit a rupee.

How the purchase must be funded

Payment must come through normal banking channels — funds from your NRE, NRO or FCNR account, or an inward remittance from abroad. Paying a seller in foreign currency notes, or directly from an overseas account outside banking channels, is not permitted.

Home loans are available to NRIs and OCIs from Indian banks and housing-finance companies, repaid through your NRE or NRO account. Which account funds the purchase also shapes how easily you can take the money back out later — repatriation is easiest to plan before you buy, not after.

Do you need to fly to India to buy?

No. A purchase — including registration — can be completed through a Power of Attorney holder acting for you in India. The PoA needs to be drafted for the specific purpose, signed before the Indian consulate in your country (or apostilled, depending on where you live), and then stamped/registered in India.

In practice most NRI purchases we assist complete without the buyer flying: accompanied and live-video site visits before the decision, PoA for the paperwork, and every offer and promise kept in writing.

The part the rules don't cover: what you're buying

FEMA tells you whether you may buy. It says nothing about whether you should. The risks that actually cost NRIs money are on the ground: projects handed over years late, developers with weak delivery records, and prices above what the corridor supports — all hard to judge from another time zone.

How should an NRI pay for property in India?

Only through banking channels: NRE, NRO or FCNR funds, or an inward remittance. Foreign currency cash or direct overseas transfers to a seller outside banking channels are not permitted. NRI home loans from Indian lenders are available and repaid through NRE/NRO accounts.
